The Aporia
Luigi Mangione, who pleaded guilty to two federal stalking charges related to the December 2024 killing of UnitedHealthcare CEO Brian Thompson, is facing opposition from the Manhattan district attorney's office over his attempt to dismiss state-level murder charges against him. The DA's filing on Friday argues that a separate state trial would hold Mangione accountable for different types of "harm or evil" than those addressed in federal court, emphasizing that statutory double jeopardy applies only when there has been a separate prosecution for the same misconduct, which is not the case here since dismissed federal charges do not count as such. Judge Gregory Carro postponed the state proceedings until December 10 and gave Mangione’s legal team until October 3 to respond after their initial motion was filed on August 17.
