Jamaal Howard, 46, is scheduled for execution by lethal injection on Wednesday in Texas, which would be the nation's 30th execution this year. In 2000, Howard was convicted of capital murder for fatally shooting Vickie Swartout, 42, during a robbery at a convenience store in Silsbee, about 161 km northeast of Houston. Surveillance video from the crime showed Howard taking $114 and a carton of cigarettes before shooting Swartout once in the chest.
Howard’s lawyers argue he is intellectually disabled and should be exempt from execution under Supreme Court rulings since 2002. However, Texas courts have not agreed, leading to two more executions scheduled after Howard's if it proceeds. This would make it Texas' seventh execution of 2026, following Tennessee's failed attempt last week to execute Christa Pike, who was reportedly awake and speaking during the procedure.
The execution marks a return to regular lethal injections in the U.S., with significant legal scrutiny over intellectual disability claims and state discretion in such cases.
