Voters in Idaho rejected ballot measure Proposition 1 on November 4, 2026, which would have codified the right to an abortion up until fetal viability. The rejection preserves Idaho’s current abortion ban, one of the strictest in the nation, implemented after the Supreme Court overturned Roe v. Wade in 2022. Proposition 1 had garnered support from reproductive rights advocates who argued it protected patient-provider confidentiality and privacy. However, with 56% voting against and 44% for, the measure failed to pass despite receiving a significant portion of votes. This outcome contrasts with results in other states where pro-choice measures succeeded due to broader Democratic Party victories in midterm elections.
Idaho voters rejected a citizen-led ballot initiative to roll back the state’s near-total prohibition on abortion, keeping in place one of the most restrictive abortion laws in the country.
Prop 1, which only required a simple majority to pass, was written to legalize abortion through fetal viability, or the point at which a fetus can survive outside of the mother without extraordinary medical intervention.
