As of October 28, 2026, Hennepin County prosecutors charged James O'Keefe, 42, and Cam Higby, 26, with felony unlawful voting and identity theft over videos they filmed during Minnesota's Aug. 11 primary. The pair visited multiple precincts in Hennepin County, misrepresented their identities as registered voters without those individuals' knowledge or permission, and posted the footage to social media to undermine confidence in Minnesota's voting systems. According to a news release from the Hennepin County Attorney's Office, the charges stem from a Minnesota law that prohibits intentionally misrepresenting one’s identity when applying for a ballot or attempting to vote. Secretary of State Steve Simon emphasized that disrupting or deceiving election workers will not be tolerated. The case involves activists who call themselves the Citizen Justice League, testing Minnesota’s 53-year-old voter identification system.
